The Civil Division of the District Attorney’s office provides the county’s elected officials and department heads with advice and counsel on complex legal questions and litigation matters relating to their daily duties. Our client is Dallas County government that is composed of the offices of 51 elected officials and 36 departments. These include the Commissioners Court, the County Clerk, the District Clerk, the Tax Assessor-Collector, the Sheriff, the Constables, the Commissioners Court Administrator, the Hospital District, the two Civil Service Commissions, the Medical Examiner, Budget, Purchasing, and all other branches of county government.
Dallas County is a plaintiff or a defendant in numerous civil lawsuits involving matters such as personal injury, property damage, civil rights, contract disputes, condemnations, mental health commitments, and more. The Civil Division’s staff of thirteen attorneys and six support personnel provides legal advice and representation to Dallas County and its various components in all civil matters.
The Civil Division reviews and revises practically every contract for goods and services between Dallas County and commercial businesses or other governmental agencies. It is vital for Dallas County to contract with commercial businesses to acquire goods and services necessary for an efficient urban community government at the lowest possible cost. The advisory attorneys use their expertise in contractual and county law to draft and review all such contracts in order to assure that their terms comply with constitutional restrictions and state law requirements.
The Civil Division’s litigation attorneys are highly qualified and represent Dallas County in the field of civil trials in state district and county courts. They are continuously engaged in significant trial dockets as well as protecting county employees and departments from unwarranted and overbroad subpoenas.
